Introduction of the First Subcommittee
Basis for Establishment
  • ＜Framework Act on Settling the Past for Truth and Reconciliation＞ Article 6(Composition of Subcommittees)
  • ① The Commission may establish a subcommittee to perform part of other duties of the Commission, such as clarifying the truth.
  • ＜Operating Rules of the Truth and Reconciliation Commission＞ Article 12 (Composition of Subcommittees etc.)
  • ① The Commission shall establish the First and Second Subcommittees according to Article 6 of the Framework Act to handle tasks such
      as preliminary deliberation and coordination of agenda items for Commission meetings, investigations, research, and other
      duties assigned by the Commission.
Composition and Operation
  • Members : One chairperson (standing commissioner) and three members (non-standing commissioner)
  • - Chair: Yi Ok-nam (standing commissioner)
  • - Kim Woong-ki (Attorney-at-Law, Chungho Partners)
  • - Oh Dong-suk (Professor, Ajou University Law School)
  • - Hur Sang-soo (Co-chair, Association for the Bereaved Families of Victims of the Jeju April 3 Incident)
  • Operation of Meetings
  • - Subcommittees are convened upon request of the chairperson or members of the subcommittee, or when deemed necessary by the subcommittee chairperson.
  • - Currently held twice a month.
Responsible Categories of Investigation
  • ① Independence movements against Imperial Japan which had been carried out during the Japanese occupation or immediately prior to that period.
  • ② History of overseas Koreans who have defended the sovereignty of the Republic of Korea and extended its national power after the Japanese
      occupation until the enforcement date of the Framework Act (December 1, 2005).
  • ③ Cases of mass civilian deaths, injuries, or missing persons which occurred unlawfully from 15 August 1945 to the period prior to, during, and
      immediately after the Korean War.
  • ④ Acts of terrorism, human rights abuse, violence, massacres, and suspicious deaths committed by forces which deny the legitimacy of the
      Republic of Korea or are hostile to the Republic of Korea from 15 August 1945 to the period of authoritarian rule.
  • ⑤ Cases of historical significance, for which the Commission deems that clarifying the truth is necessary to achieve the purpose of the
      Framework Act (ex-officio investigations).

  • ① Matters related to “Decisions of Rejection” according to Article 21 of the Framework Act.
  • ② Matters related to “Commencement of Investigations” according to Article 22 of the Framework Act.
  • ③ Matters related to “Preliminary Investigations” according to Article 22.(2) of the Framework Act.
  • ④ Matters related to “Testimony Interviews Conducted at a Third-Party Location” according to Article 7.(2) of the Operating Rules.
  • ⑤ Matters related to “On-site Investigations” according to Article 23.(4) of the Framework Act.
  • ⑥ Matters related to “Requests for Submission of Necessary Materials or Articles” according to Article 23.(6) of the Framework Act.
  • ⑦ Matters related to “protecting a witness or an appraiser, securing related materials, or to prevent the destruction thereof” according to Article
      30.(5) of the Framework Act.
  • ⑧ Matters related to “protecting the privacy and honor of persons subject to investigation” according to Article 31.(3) of the Framework Act.
  • ⑨ Matters forwarded from the Commission to the Subcommittee.
  • ⑩ Other matters stipulated by the rules of the Commission or forwarded to the subcommittee by the chairperson of the Commission or
      Subcommittee as deemed necessary.
